WHAT IS A PROCESS SERVER:

Process Serving is the physical act of executing Judicial Notice on a Defendant. Meaning... the actual exchange of the summons or court documents to its intended recipient.

WHAT IS CONSTABLE COURT SERVICE:

CAN I BE SERVED WITH COURT DOCUMENTS AT WORK:

The Law, The Courts and The Justice of the Peace, gives extended latitude in the Service of Process, which allow service to be conducted at anytime of day. Furthermore, The Law understands that service may have to be conduct at a moments notice or at an unusual hour of day to satisfy service. Its important to understand that, when a summons has been issued with the courts seal or authority that appears on the documents to be served, that Summons can be served anywhere within that courts jurisdiction. Without the summons page on the complaint, the Court would not have the jurisdiction to hear the case. The Process Server can go anywhere where that court has jurisdiction to execute service.

WHY WOULD I NEED A PROCESS SERVER:

A Process Server is Professional Person whose job is to serve court documents. The Process Server should be familiar with court procedures and be proficient in the Rules of Civil Procedure. A good Process Server will most likely always be able to articulate the circumstances in which service of process is executed and be available and able to testify if necessary. 

CAN MY FAMILY MEMBERS BE SERVED IN MY PLACE:

Most states allow the substitute service of any person(s) who reside within the household who meets the Laws require of suitable age and discretion... Maryland allows the Process Server to serve any resident over the age of 18, and or is of suitable age and discretion.

WHAT IS THE LATEST TIME THAT A PROCESS SERVER CAN COME TO YOUR RESIDENCE:

The Law gives great latitude to the Process Server to serve these documents 24 hours a day. The rule of thumb is that no one is above the law and the can not and will not be ignored.

WHERE CAN I GET A PROCESS SERVER TO SERVE COURT DOCUMENTS OUT-OF-STATE:

CAN I THROW A PROCESS SERVER OFF MY PROPERTY:

Sure you can, but it would be to your benefit to wait until he/she leaves. Some States have special Laws in place for the assault or battery of a Process Server. If the Process Server is serving United States Court Documents and you threaten of assault that person, the U.S. Marshal will be the Investigating Official and you can be charged with a felony.

DO I HAVE TO ACCEPT THE COURT DOCUMENTS:

Rule of thumb, no one is above the law. Imagine of everyone said that they were not going to accept court papers did not have to show up for court. There would not be any cases heard. The Law allows the Process Server to drop the papers on the ground in your presence. Also, the court will enforce and alternate method if you try to avoid services by ordering the posting of the documents to your dwell or home. At that point, it doesn't matter if anyone is home or not, by posting the papers, services is executed.
